Terms of Service

A non-refundable deposit is required alongside agreement to these terms in order to book a commissioned slot. If you have any questions related to the below terms, please don't hesitate to reach out for clarification.

1. Communication and Adaptability

  • Open Communication: Catchlight Designs values clear, respectful communication and aims to provide a positive, collaborative experience for every client. Clients are encouraged to reach out at any stage of the process if they have questions and concerns.

  • Responsiveness: Every effort will be made to address queries, and accommodate reasonable requests in a prompt manner. Response times can vary during busier seasons.

  • Flexibility: Additions, adjustments, and special accommodations can be made upon request; however, these may incur additional fees.

 

2. Payments and Deposits

  • Domestic Payments: Will be processed via bank transfer or, upon request, through PayPal (G&S - subject to a 4% transaction fee). All AUD prices are inclusive of GST.

  • International payments: Will be processed via PayPal Invoice in your preferred currency. Clients may choose to pay in two or more instalments. This option will incur an additional administrative fee of approximately $10 USD (or equivalent in other currencies) per instalment. Alternatively, clients may opt to pay the full amount upfront, in which case no additional fees will apply.

  • Deposit Requirement: A non-refundable deposit is required to secure a booking. The deposit amount will be confirmed based on the required design. This confirms your place in the production schedule and helps to cover preliminary administrative, design and material costs.

  • Commencement of Work: Design and production work will not commence until the deposit has been received and confirmed.

  • Final Payment: The remaining balance must be paid in full prior to shipment. No items will be released until payment is received and cleared.

  • Late Payments: Late payments may cause production or delivery delays. In cases of significant delay, the booking may be cancelled at the maker’s discretion. Payments made up to cancellation, including the deposit, are non-refundable.

3. Cancellations and Refunds

  • Deposits: All deposits are non-refundable.

  • Pre-Production Cancellations: Refunds for overpayments or cancellations made before production begins (beyond the deposit) are considered case-by-case and may incur administrative fees.

  • Completed Costumes: Due to the custom nature of the product, no refunds will be issued after the costume has been completed and shipped, except in cases of demonstrable manufacturing defects.

 

4. Pre-Booking Without a Brief

  • Slot Reservation: Clients may reserve a slot in advance without completing the design form. A deposit of $55 AUD (incl. GST) / $50 USD per slot is required. This deposit will be credited towards the final costume cost. An additional deposit amount may be requested before work commences if specific materials need to be ordered.

  • Non-Refundable Deposits: Deposits for reserved slots are non-refundable in the event of cancellation.

  • Design Alignment: Clients must ensure their preferences align with Catchlight Designs’ style and aesthetic prior to reserving a future slot. Catchlight Designs reserves the right to cancel bookings if the design brief conflicts with the my design style and no agreement can be reached.

  • Incomplete Design Briefs: If a complete design brief is not received at least 6 weeks prior to the confirmed send-by date, the booking may be cancelled.

 

5. Design Brief and Service

  • Design Brief Form: Clients must complete a detailed form outlining the desired costume style before sketching begins. Major changes after submission may incur additional fees.

  • Original Designs: Catchlight Designs does not replicate previous designs, whether created internally or by other designers. Reference images may be used as inspiration.

  • Creative Freedom: The more creative freedom a client allows, the more refined and distinctive the final design is likely to be.

  • AI References: AI-generated images are not accepted as reference material due to unrealistic finishes and potential copyright issues.

 

6. Fabrics and Materials

  • Colour Variations: Fabric colours may differ in photographs or on monitors due to lighting and screen settings, especially neon shades.

  • Special Orders: Specific fabrics can be requested, but may incur additional costs. Colour changes prior to production may also incur fees.

  • Lining:

    • Medium-weight fabrics typically include a lining (tan or white lycra).

    • Heavy-weight fabrics (velvet, thick lycra, darker colours, or shimmer finishes) may not require lining.

    • Mesh or lighter lining may be used if required for design purposes.

    • Pants, unitards, or shorts will not be lined.

    • Mesh cutouts will only be lined if specified or requested.

 

7. Measurements, Fit, and Alterations

  • Accuracy & Responsibility: Clients provide all measurements. Catchlight Designs is not responsible for inaccuracies. Allowances for growth must be included in measurements.

  • Guidance & Verification: Instructions are included in the design sketch. Clients may provide photos for verification and seek clarification prior to submission.

  • Fittings: In-person fittings are not typically offered but can be discussed on a case-by-case basis.

  • Fit Issues & Communication: Any fit issues must be reported within one week of delivery. Catchlight Designs will review measurements and explore solutions. 

  • Post-Delivery Alterations: Any alterations due to growth, body changes, or inaccurate measurements are the client’s responsibility. Catchlight Designs is not liable for third-party alteration costs.

  • Acknowledgement: By placing an order, the client accepts full responsibility for the accuracy of provided measurements.

 

8. Timeline and Communication

  • Design & Feedback: Adequate time must be allocated for consultations, revisions, and approvals (allow at least six (6) weeks).

  • Client-Provided Information: Timely submission of all measurements, photos, and relevant information is critical. Late submissions, delayed briefs, late payments, or slow responses may impact the timeline and result in missed deadlines.

  • Communicating Deadlines: Clients must communicate any firm deadlines (events, delivery dates) at booking.

  • Timeline Changes: Requests for changes must be made promptly. While considered, changes may affect costs and delivery dates.

 

9. Shipping and Handling

  • Liability: Catchlight Designs is not liable for delays caused by postal or courier interruptions, or for lost, stolen, or damaged parcels once dispatched.

  • Delivery Dates: Clients must specify a required “send-by” date. Domestic clients should allow 7–10 business days, international 10–12 business days.

  • Shipping Methods: All parcels are dispatched via standard delivery with tracking included; the cost is incorporated into the costume price. Express shipping is available at an additional cost.

  • Insurance: Shipping insurance is available upon request or included automatically for costumes $550 AUD / $400 USD or more.

  • International Duties & Taxes: International clients are responsible for any applicable duties, taxes, or customs tariffs imposed by their country of import. These charges are not included in the costume price or shipping fees and must be paid by the recipient upon delivery, if required by local authorities.

     

    Please Note: Clients based in the United States should be particularly aware of heightened tariffs and evolving customs regulations, which may affect the total cost upon import. It is strongly recommended that U.S. clients consult the most current customs and import regulations prior to placing an order.

 

10. Care and Maintenance

  • Client Responsibility: Proper care becomes the client’s responsibility upon receipt.

  • Handling & Cleaning: Spot clean only; never machine wash. Use gentle methods and mild detergents.

  • Rhinestone Maintenance: A spare bag of stones is provided. Clients should perform minor repairs as needed.

  • Liability Disclaimer: Catchlight Designs is not liable for damage from improper care or normal wear and tear.

 

11. Intellectual Property and Design Rights

  • Ownership: All sketches, designs, and finished costumes remain the intellectual property of Catchlight Designs.

  • The sharing of costume design sketches with other costume makers—whether as reference material or for the purpose of replication—is strictly prohibited.

  • Reproduction: Sharing, copying, or replicating designs without written consent is prohibited.

  • Promotional Use: Completed costumes may be photographed and shared for portfolio, marketing, or promotional purposes.
